A Nebraska state senator plans to appeal a court decision to throw out his lawsuit against God.
Nebraska State Sen. Ernie Chambers, an atheist, filed suit against God, asking for a permanent injunction to stop “fearsome floods, egregious earthquakes, horrendous hurricanes, terrifying tornadoes, pestilential plagues, ferocious famines, devastating droughts, genocidal wars, birth defects and the like.”
Chambers went to court last year after the state legislature tried to limit so-called frivolous lawsuits. The Omaha activist believes Chambers v. God makes a statement that citizens have the right to sue anyone.
Douglas County District Judge Marion Polk ruled that there was no evidence God had been served notice of the lawsuit and dismissed the case with prejudice.
Chambers said he has found a hole in the judge’s ruling. Since the court acknowledges the existence of God when it reads the court’s invocation, he asserted, God’s omniscience is being recognized.
“Since God knows everything, God has notice of this lawsuit,” he told the Associated Press.
